Our blueprint for litigation and dispute resolution is simple: approach every case systematically; develop a suitable position and strategy; and negotiate from strength or litigate in court where necessary.
Consultation: We clarify your litigation and dispute resolution goals, map the relevant facts, map the available evidence, identify the procedural stage of your dispute, and spot any imminent deadlines. Instructions: Once retained, we clarify relevant facts, request the available evidence, and confirm your instructions to prepare a preliminary analysis of your case. Analysis: Using our substantive and procedural frameworks, we identify the available remedies, the legal tests that must be met, the evidence required to satisfy them, and any key procedural requirements or deadlines.
Substantive Positions Assessment: Based on our analysis, experience, and your litigation and dispute resolution goals, we assess potential substantive positions grounded in the evidence and the law. Procedural Strategies Assessment: Based on our analysis, experience, and your litigation and dispute resolution goals, we assess potential procedural strategies grounded in the law. Position and Strategy Advice: Based on our assessments, we advise you on a clear and suitable substantive position and procedural strategy.
Negotiate out of court: We strategically advance your position to negotiate with the opposing party from a place of strength, towards an out-of-court resolution that is favourable to you. Litigate in court: Where negotiations do not produce an out-of-court resolution that is favourable to you, we litigate your case in court according to your instructions.
